That's kind of a bizarre stance to take, there's a difference between drinking in public and being drunk and disorderly.
Yea, America's kind of all over the map when it comes to drinking laws. Heritage of our Puritan roots. Remember we're the country that banned drinking altogether for a couple of years before realizing that was an awful idea. Looks like every state has areas where there are no-public drinking laws. I assume the two lines of thought are being extremely strict on public drunkedness (as in not leaving it to the officer's discretion) and sort of a "protect the children/keep up appearances" sort of vibe. I can see open-container laws being unnecessarily strict, but on the other hand I respect if a municipality doesn't want to come across as a town where people heavily drink. Judging from this map, most open-container areas are those of entertainment districts, and that's the image public drinking gives off.
